This Terms and Conditions ("Terms of Use") Agreement ("Agreement") governs your use of the Homo Sentient application (the "App") and any related services offered in connection with the App (collectively, the "Services"). The Services are provided by Homo Sentient Inc. ("us", "we", or "our").
By using the App, you agree to be bound by this Agreement. If you do not agree to these terms, you may not use the App or the Services.
1. Acceptance of Terms
The Services are offered subject to acceptance of all the terms and conditions contained in this Agreement and all other operating rules, policies, and procedures that we may publish from time to time. We reserve the right to amend these terms at our discretion. Your continued use of the Services following any amendment constitutes your acceptance of the amended Agreement.
2. User Accounts and Authentication
To access and use the Services, you may need to register and create an account (your "Account"). You agree to provide accurate, current, and complete information during the registration process. You are solely responsible for safeguarding your Account and for all activities that occur under your Account.
3. User Content and Conduct
The App provides users with the ability to create generative AI art. You retain all rights to the content you create but grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods.
You agree not to use the App to create content that is unlawful, defamatory, obscene, invasive of privacy, or otherwise objectionable. We reserve the right to remove any content that we determine, in our sole discretion, violates these restrictions.
4. Advertising
The App may include advertisements, which may be targeted to the content or information on the App, queries made through the App, or from other information. The types and extent of advertising on the App are subject to change. In consideration for us granting you access to and use of the App, you agree that we and our third-party providers and partners may place such advertising on the App.
5. Intellectual Property
All content in the App, excluding User Content, including but not limited to text, images, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Homo Sentient Inc. Use of any of this property for any reason without written consent from us is strictly prohibited.
6. Disclaimer of Warranty and Limitation of Liability
The App and Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not warrant that the App or Services will be error-free, secure, or uninterrupted. We will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses.
7. Governing Law
This Agreement is governed by the laws of the country where Homo Sentient Inc. is established, without regard to its conflict of law provisions.
8. Severability
If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect and enforceable.
9. Termination
We may terminate or suspend your access to the Services, at our sole discretion, at any time and without notice to you, while endeavoring to provide reasonable notice.
